  1. Purpose and Scope

We, Social Home Inc. (“Company” / “we” / “our” / “us”), are committed to protecting the privacy of our users ("you" / "your" / "yourself"). We consider privacy and protection of your data/ information to be of utmost importance. Our practices and procedures in relation to the collection and use of your data/ information have been set out below in this privacy policy (“Privacy Policy”).

 

For the purpose of this Privacy Policy, sensitive personal data or information of a person (“Sensitive Personal Data”) is as defined under the Information Technology Act 2000 (“IT Act”) and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules 2011 (“SPDI Rules”). Words and expressions used in this Privacy Policy but not defined herein but defined in the IT Act or SPDI Rules will have the meanings assigned to them thereunder. Please note that usage of the term Personal Information in this Privacy Policy includes Sensitive Personal Data, wherever appropriate and/or mandated under the IT Act and the SPDI Rules.

 

The aim of this Privacy Policy is to ensure that you understand what Personal Information we collect about you, the reasons for collection and use, and entities we share it with. By providing your consent to this Privacy Policy, you agree to the collection, use and transfer of your Personal Information as set out in this Privacy Policy.

c.         telephone number and mobile number, if required;

d.         data related to the account through which you make in-app purchases such as your Apple ID and Google Play Store Account;

e.         date of birth;

f.          pronouns the users identify as: he/him, she/her or they/them;

g.         location data; and

h.         passwords

i.           Instagram Username

j.           LinkedIn Username

k.         Personal Website Name

 

ii.        You represent that the Personal Information you provide from time to time is and shall be correct, current and updated and you have all the rights, permissions and consents to provide the same. Your providing Personal Information and the Company’s consequent storage, collection, usage, transfer, access or processing of the same shall not be in violation of any third-party agreement, laws, judgments, orders or decrees.

 

iii.       Please note that you will be required to give Personal Information as specified above, only if you sign up for our application. Therefore, there is no compulsion on those who simply browse our application to provide any Personal Information without availing any of our products or services. At all points, it is advised that you exercise strict caution while submitting any Personal Information about you or your family members.

 

iv.       The Company also tracks information provided by your browser, including the website you came from (known as the referring URL), the type of browser used and other information that does not personally identify you. This may include installation of cookies and collection of other session data.

 

  1. Use and Processing of your Personal Information

The Personal Information collected by the Company may be used for a number of purposes connected with our business operations which may include the following:

  2. dealing with requests, enquiries and complaints, customer services and related activities;
  3. responding to your queries and fulfilling your requests for information regarding our products and services;
  4. to customize our offerings for you;
  5. to analyse user trends and help improve our offerings;
  6. notifying you about our new products or services and sending you important information regarding our products or services;
  7. to identify you, to understand your needs and resolve disputes, if any;

  9. responding to judicial process and provide information to law enforcement agencies or as permitted by law.

 

  1. Disclosure and transfer of your Personal Information
  1. We may disclose/ transfer your Personal Information to our service providers and other third parties as necessary or appropriate, for:
  1. providing services, technical support, etc. in relation to our products and services;
  2. monitoring and enhancing your interest and engagement with our application;
  3. processing your in-application purchases;
  4. complying with any legal process whether local or foreign;
  5. detecting and preventing identity theft, fraud or any other potentially illegal acts;
  6. responding to requests from public and government authorities, including public and government authorities outside your country of residence;
  7. providing to our advisors such as lawyers, chartered accountants and financial advisors in connection with business transactions; and
  8. enforcing our policies.
  1. The Company may also disclose or transfer your Personal Information to another third party as a part of reorganization or a sale of the assets or business of the Company to such third party. Any third party to which the Company transfers or sells its assets will have the right to continue to use such Personal Information.

 

  1. Your rights in relation to your Sensitive Personal Data collected by the Company
  1. All Sensitive Personal Data provided to the Company has been voluntarily provided to us by you. You have the right to withdraw your consent at any time in writing by writing an email to support@orotheapp.com in accordance with the terms of this Privacy Policy. However, please note that withdrawal of consent will not be retrospective in nature and shall be applicable prospectively. In case you do not provide your information or consent for usage of Sensitive Personal Data or subsequently withdraw your consent for usage of the Sensitive Personal Data so collected, the Company reserves the right to discontinue the services for which the said information was sought.

 

  1. You may write to us at support@orotheapp.com to access, review, amend or correct your Sensitive Personal Data or withdraw your consent to provide Sensitive Personal Data. However, we are not responsible for the authenticity of the Sensitive Personal Data provided by you.

 

  1. You may opt-out of receiving non-essential, promotional, or marketing-related communication from us. If you wish to remove your contact information from our lists, you may click on the "unsubscribe" link or follow the instructions in each e-mail message.   1. You agree and acknowledge that in respect of any Sensitive Personal Data which cannot be corrected or amended pursuant to any applicable law, law enforcement requests or judicial proceedings or the like, the aforementioned rights will not be available.

 

  1. Security Practices and Procedures
    1. We use reasonable security measures at the minimum those mandated under the IT Act and the SPDI Rules, to safeguard and protect your Sensitive Personal Data. Further, we securely store your Personal Information only as long as required for lawful purposes or as mandated by law.

Notwithstanding anything contained in this Privacy Policy or elsewhere, we shall not be held responsible for any loss, damage or misuse of your data/ information, if such loss, damage or misuse is attributable to a Force Majeure Event. A “Force Majeure Event” shall mean any event that is beyond our reasonable control and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.
  1. Third-Party Sites

We do not exercise control over the websites displayed as search results or links on our application. These other sites may place their own cookies or other files on your computer, collect data or solicit Personal Information from you, for which we shall not be held responsible or liable. We do not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor do we guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by us of such websites, the websites’ provider, or the information on the website.

The Company reserves the right to revise and update this Privacy Policy at its sole discretion and without any advance notice.  Any such revisions will be effective on and from the date of posting the same on the Company’s website and will apply to all Personal Information collected both prior to and following the effective date. The Company shall not be required to notify you of any changes made to this Privacy Policy. It is your responsibility, in such cases, to review the terms of this Privacy Policy from time to time.
